1. Acceptance of Terms
By accessing or using this website (wencestudio.com), you agree to these Terms of Service. If you do not agree, please do not use the site. WenceStudio by SmartDesign ("WenceStudio," "we," "us," or "our") may update these terms from time to time as described in Changes to These Terms below.
2. Eligibility
You must be at least 18 years old to use this site and our paid services. If you use this site or engage WenceStudio by SmartDesign on behalf of a business or organization, you confirm that you have the authority to bind that business or organization to these terms.
3. Use of the Site
You may use this site to learn about our services, take the Creator AI Operating System Scorecard, read Insights content, and contact us. You agree not to misuse the site: no attempting to disrupt its operation, scrape it at scale, misrepresent your identity when submitting forms, or use it for any unlawful purpose. The Scorecard is a self-assessment tool intended to prompt reflection and prioritization; it is not a certified or scientifically validated diagnostic, and its results should be treated as directional.
4. Intellectual Property
The content on this site, including text, the AETHER Method framework, graphics, logos, and site design, is owned by WenceStudio by SmartDesign or its licensors and is protected by applicable intellectual property law. You may view and share this content for personal, non-commercial reference. You may not reproduce, redistribute, or create derivative works from our content, templates, or prompt systems for commercial purposes without our written permission. Templates and prompt systems purchased through our storefront are licensed for the use described at the point of purchase; they are not resold or relicensed to third parties.
5. Service Engagements
Descriptions of services and deliverables on the Services and Pricing page help you understand scope and fit. They do not constitute a binding offer. Final scope, deliverables, timeline, and price for any paid engagement (7-Day Sprint, 14-Day Content Pipeline, or Team AETHER) are confirmed in a separate written agreement or proposal before work begins. Nothing on this site guarantees specific business outcomes, revenue, or results; outcomes depend substantially on how consistently a system is implemented and used after delivery.
6. Refunds and Cancellations
Refunds and cancellations are governed by our Refund Policy and by the written agreement for your engagement. If they conflict, the written agreement controls.
7. Disclaimer
WenceStudio by SmartDesign provides design tools that use AI, automation tools, and professional services, including templates, logos, branding, presentations, and training. No results or revenue are guaranteed. All materials are copyright-protected. Outcomes vary. Tools may change as AI and design advance.
8. Client Deliverables
Clients own the prompt schemas, connectors, and documentation delivered in an engagement from day one.
9. Third-Party Services
We use third-party services to run this site and our work, including Calendly for scheduling, Beehiiv and Substack for newsletters, Beacons for our storefront, Formspark for contact form delivery, and Google Tag Manager, Google Analytics, and Vercel Analytics for site usage. Each provider handles information under its own terms and privacy policy, and we are not responsible for their services. Links to other websites are provided for convenience, and we do not control or endorse them. See our Privacy Policy for how information is handled.
10. Suspension and Ending Engagements
We may restrict access to this site if these terms are violated. Either party may end a paid engagement as described in the written agreement for that engagement, and refunds are handled under the Refund Policy.
11. Limitation of Liability
This site and its content, including the Scorecard, are provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, WenceStudio by SmartDesign is not liable for any indirect, incidental, or consequential damages arising from your use of this site or reliance on its content. Nothing in these terms limits liability that cannot be excluded under applicable law.
12. Governing Law
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles, unless a separate written service agreement specifies otherwise.
13. General Provisions
These terms, together with our Privacy Policy, our Refund Policy, and the written agreement for any paid engagement, are the entire agreement between you and WenceStudio by SmartDesign about this site and our services. If any part of these terms is found unenforceable, the rest remains in effect. If we do not enforce a provision, that does not waive it.
14. Changes to These Terms
We may update these terms as the site or our services change. Material changes will be reflected by updating the "Last updated" date at the top of this page. Continued use of the site after changes are posted constitutes acceptance of the updated terms.
